Supreme Court hands down judgment in the FCA’s Business Interruption Insurance Test Case

On 15 January 2021, the Supreme Court handed down its decision in the FCA Business Interruption Test Case. Sam Moore has prepared a note on the case.  The insurers’ appeals were dismissed although the Supreme Court reached that decision via by fundamentally different analysis to the High Court in a number of important respects.  A copy of the note can be accessed here.
